Sweepstakes registration data and the referral email addresses and names provided by entrants are processed in the United States and in accordance with U.S. privacy law.
1) Description of Sweepstakes – Statewide, Inc., (d/b/a Penguin Windows),(the “Sponsor”) is offering the “Penguin Windows Heating Rebate Sweepstakes” (the “Sweepstakes”) and will award a Grand Prize based on a random selection from all valid entrants in the Sweepstakes. The Sweepstakes begins 12:01 AM US Pacific Time (PT) on July 1, 2008 and ends at 11:59 PM US PT on September 30, 2008 (“Sweepstakes Period”).
2) Eligibility - Sweepstakes is open to legal residents of Oregon and Washington only. Entrants must be home owners and must demonstrate such in order to collect the prize. Employees, officers and representatives (and members of their immediate families and those living in the same household of each) of Penguin Windows, its parent, subsidiaries or affiliated companies, its advertising and promotion agencies and any company involved in the design, execution or production of the Sweepstakes are not eligible. Promotion is void where prohibited or restricted by law.
3) How to Enter –
Visit http://www.penguinwindows.com/enter_contest.html to enter. Enter all of the information required in the fields marked with an “*” and hit the “submit” button. By hitting the “submit” button you give Penguin Windows permission to contact you for the purpose of confirming your entry in this contest and to offer you a free energy and security inspection regardless of whether you have signed up for any “Do Not Call Registry”. You are not required to agree to an in-home demonstration in order to qualify to receive the Prize, described below.
In the alternative, an e-mail may be sent to info@penguinwindows.com with the subject line reading “Penguin Windows Sweepstakes” or by mailing a postcard to 15125 Highway 99, Lynnwood, WA 98087. These alternative submissions must contain all of the information required to be entered on the submission page above. In the event you choose to register via e-mail or postcard, you may be contacted to verify information in the e-mail or postcard.
There is a limit of one sweepstakes entry per person/address per month. Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
By entering via any means, you agree to be bound by these Official Rules.
4) Grand Prize and Odds of Winning: One Grand Prize Winner will be selected to receive $10,000 in Free Penguin Windows and $10,000 in CASH. The odds of winning are dependant on the number of eligible entries received during the Sweepstakes period.
5) General: You must be registered with Penguin Windows through the website listed above at the time of winner selection to be eligible for the Prize. Drawing will be conducted on or about October 15, 2008, and the potential winner will be notified by phone and/or email within 2 days of the drawing. The potential winner of the Grand Prize will be required to complete an Affidavit of Eligibility and a Liability/Publicity Release (unless prohibited by law). The Affidavit, and Liability/Publicity Release must be returned within (10) days of receipt of these documents. Potential winner will also be required to send a copy of his/her passport, driver’s license, birth certificate or other appropriate documentation (acceptable to Sponsor) as proof of age and residency. Non-compliance with any of these requirements will result in disqualification, in which case an alternate winner will be chosen. Return of prize notification and/or the Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be selected. Once a Potential winner has complied with the above and becomes an Actual Winner, in the event the Actual Winner fails to provide adequate documentation for reimbursement under paragraph 4 above within 30 days of the end of each calendar month, any remaining amount of the Prize is automatically forfeited and Sponsor shall not be required to name an alternate winner.
The Prize is not transferable, either to another person, or to another home. The Prize cannot be redeemed for cash directly, and there are no substitutions or cash options available. If, for reasons beyond the Sponsor’s control (including, but not limited to, tampering or computer virus infection), the Sweepstakes is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Sweepstakes, without liability and to the extent feasible, will award prizes among entries received prior to cancellation or modification. Sponsor will not be responsible for lost, late, misdirected, entries or for Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays. Entries are void if they contain typographical or other errors. Entries, which are incomplete, inaccurate, forged, irregular in any way, or created by repetitive programming or are otherwise not in compliance with these Official Rules, are also void.
All entrants agree to comply fully with each provision in these Official Rules. Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for any prize(s) and may be prosecuted to the full extent of the law.
By submitting an Entry, you grant to Penguin Windows, the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), e-mail address, voice, biographical information, and written or oral statements, for advertising and promotional purposes in promoting or publicizing Penguin Windows and its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e‑mail address, biographical information, or entry.
ANY AND ALL TAX LIABILITY OF ANY KIND RESULTING FROM THE WINNER’S RECEIPT OF THE PRIZE IS THE RESPONSIBILITY OF THE WINNER.
6) Release of Liability and Issues of Law: By participating in this Sweepstakes, all entrants release Penguin Windows, its parent, subsidiary and its affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion from any and all liability with respect to and in any way arising from participating in this promotion, acceptance or use of prizes. Entrants also agree that Penguin Windows’ and its parent, subsidiary, its affiliates, partners, officers, directors, agents, employees and all entities associated with the development and execution of this promotion are not responsible or liable for any injury or damage to an entrant's or third person's computer related to or resulting from the Sweepstakes, the Entries and/or its prizes. The Sponsor is not liable for damage to a user's computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an entrant's participation in the Sweepstakes or downloading of information in connection with the Sweepstakes. The Sponsor reserves the right to modify or cancel the Sweepstakes in the event that any portion of any website used to administer any aspect of the Sweepstakes becomes technically corrupted.
All Federal, state and local laws and regulations are applicable. THE WASHINGTON STATE COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF WASHINGTON SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS. The Sweepstakes is void where restricted or prohibited by law.
7) Information About the Winner: For the name of the winner, send a send a stamped, self-addressed envelope to: 15125 Highway 99, Lynnwood, WA 98087. Requests must be postmarked no later than October 31, 2008. Washington residents may omit return postage.
